As our client, we will always do our best to fulfil your needs and meet your goals. To make sure we’re on the same page, it’s best to have a few simple things written down so that we both know what happens if things go wrong.
In these terms of service you won’t find complicated legal terms or large passages of unreadable text – we have no desire to trick you into signing something that you might later regret.
We do want what’s best for the safety of both parties, now and in the future.
1. Scope of Services
Seriously Good Design (“SGD”, “we”, “our”, “us”) provides:
Web design and development
SEO strategy and implementation
Google Ads management
Ongoing website support and hosting
Other digital marketing services
Some services are delivered monthly on a fixed-deliverable basis.
2. Payment Terms
All monthly services are billed and payable in advance
Payment is via direct debit or credit card unless otherwise agreed
Invoices are due on the due date listed on the invoice and cover the upcoming month
Services may be suspended after 30 days of non-payment
We may cancel your services if payment remains overdue after 30 days
You agree to cover our costs for collecting overdue payments (admin time, debt collection fees, etc.)
No refunds or credits for mid-month cancellations; we continue service through to period-end
3. Cancellation & Pausing
Written notice is required for all cancellations (30 days minimum)
SEO may be paused with 30 days’ written notice (though we recommend against it as it will negatively impact your performance)
Website support cannot be paused and is required for all active clients
Growth Plans require a 3-month initial term (can be cancelled during this period), followed by a 12-month commitment
4. Support Services
Support is provided on a best-effort basis during business hours
No SLA unless separately agreed in writing
Hosting is included in our support service
If you choose to host elsewhere, SGD is not responsible for issues related to performance, security, or compatibility
5. Ownership & Licensing
Once paid in full, you own all final design, written content, and media created for you
SGD retains ownership of source code and grants you a licence to use it for your website
You are responsible for ensuring you have rights to all materials you supply to us
6. Portfolio Use
We may showcase your project in our portfolio and marketing unless requested otherwise in writing
7. Security & Liability
We cannot guarantee your site will be immune to hacks or malicious activity
If issues arise post-launch, fixes will be quoted and billed separately
SGD is not liable for any loss of profits, data, or revenue related to the use or failure ofthe website or services
8. Post-Launch Warranty
Website projects include a 30-day bug fix period
After this, support is only available under a paid plan
9. Third-Party Costs
Costs like ad spend, WordPress plugins, or stock photos are not included and are billed separately or paid directly by you
10. Legal
These terms are governed by the laws of Victoria, Australia
If any section is deemed unenforceable, the rest remains valid
This agreement cannot be transferred without our written consent
